When a person in a wheelchair or mobility scooter is drunk, does that count as drink-driving?

This is not meant to be offensive I'm just curios as my friend is in a wheelchair and he told me that it was.


Any motorized machine whether it be a scooter, motorized wheelchair, motorcycle, vehicle, etc., I believe that under the motor vehicle act, that it still counts as driving under the influence.

You should have said exactly what you just told us in your question.

If you're not happy giving him an honest answer then you could have said that you'd prefer not to talk about it. All polite people will accept that as a valid answer, it's only rude people who won't.

If you'd prefer to make a joke out of it you could just say that you're plain lazy, or that you were in an accident involving a llama and a trampoline (or other random accident ingredients you like) and let him imagine for himself or realize it's a joke.

Your health is your business, you can tell people as much or as little as you like and you shouldn't be made to feel bad for not sharing the information with anyone.

Is a ELECTRIC PERSONAL ASSISTIVE MOBILITY DEVICE (electric wheelchair) considered a vehicle in Texas?

The traffic code governing this is 551.201. We have a debate between another officer and myself whether you can write a DWI on someone in a electric wheelchair. I say he is considered a pedestrian (I am a rookie officer but freshly studied traffic code) he is a vetern officer who is very experienced. We are looking for the textbook answer, not what we can do in the courtroom. We welcome your opinions.


No, not for purposes of DWI. Keep in mind that DWI is covered by the Texas Penal Code. The Texas Transportation Code is not relevant for DWI.

Driving while intoxicated is covered under Section 49.04 of the Texas Penal Code, which refers to a "motor vehicle". Section 49.01 refers us to Section 32.34(a) for the definition of a "motor vehicle".

Section 32.34(a) of the Texas Penal Code defines "motor vehicle" as "a device in, on, or by which a person or property is or may be transported or drawn on a highway, except a device used exclusively on stationary rails or tracks."

Obviously, an electric wheelchair cannot transport a person on a highway, so it's not a motor vehicle according to the Texas Penal Code.

i've not critised genuine wheelchair users. just seeing how many people are using them - especially if they're obese and need to walk for exercise.


half the people who have them are over so over weight thats why they have them, it makes me sick andyou always see them eating while driving. Lazy fat people! and its paid for by are tax money, wasted!

    Unable to do so at his university dorm, Komsky drove to a campus parking garage at 1 a.m., put on an opera CD, sat on a chair by his car door and — not to be deterred by occasional passers-by who were yelling at him to keep quiet — Komsky sang his heart out.

    “That was really the only way I could practice, freshman and sophomore year,” he said. “I was singing in a garage imagining I was performing in front of an audience.”

    Now, Komsky, 24, finally gets that chance. After garnering the attention of Hollywood premiere vocal teacher Seth Riggs, with whom he’s entrusted his training, the Danville resident and 2007 UCLA graduate returns to the East Bay to perform in his first solo concert March 19 at the Lesher Center for the Arts in Walnut Creek. The concert, which will benefit the Wheelchair Foundation, has already sold out; Komsky is currently working on getting another concert date and venue soon.
