Can you get sued for blocking in a car that needs a Wheelchair acess ramp?
245

I'm a little worried for my Grandad, as he told me

On sunsday he went to a market where people were employed to direct the cars where to go in the car park.
The cars were all parked in lines together and he was told just to park next in line.

When he got back to his car, there was a man in a wheelchair waiting very angrily next to my Grandads car and as my Grandad approached his car the man (in about his 20's) asked him if it was his car? and my Grandad obv. said yes, then this man stated shouting abuse at him telling him he didn't leave any room for his wheelchair access ramp. But like swaering and shouting at my Grandad.
The man told my Grandad that he has taken down his plate no. and stuff and he will be trying to sue my grandad or get him penalised for it.
Because he had a sticker on his window saying 'please leave room for wheelchair access ramp' But my Grandad didn't see this.

Could my Grandad get into trouble for this ? Could he get sued or Penalised like the man said ?

Thanks or all the help
xx
Edit*
It wasn't a store, it was a field for a market, there were no diabled parking spots or lines or anything.
Edit*
SJ2009 - I f he had seen the sticker in the window of course he would have not parked there. He did not do this to spite the man !
I have a brother in a wheel chair and i know how hard it can be for him to get in and out of cars, so in no way was this done intentionally.

To answer your question, can he be sued, YES, he can be sued just as anyone can be sued for any reason. Can he be found liable? Can he be penalized by the police? That all depends.

In most parking lots, areas reserved for handicapped access is clearly marked. Most of the times, it has signs and blue lines. If he used these spots or somehow crossed the line into blue areas, it is punishable by law.

However, if he didn't cross the line but somehow the man thought your grand-pa blocked him in some way, well... that's his problem. He isn't guaranteed any special rights or considerations beyond what the federal and state law says. He can ask, and most of the times his condition is understood and honored, but that's different from demanding and penalizing others.

As long as the store was following federal guidelines for these spaces, there is nothing he can do.

-Edit-

I see it wasn't a store, but it still is a private property. If the man feels the owner (of the property) didn't adequately meet Federal requirements, he can take it up with the management of the Flea Market.

As to your grand-pa not seeing his sticker, unless your state has some type of special sticker, then it's just his sticker. It has no more power than "baby on board" sign on cars. Your grandpa has no legal requirement to see it or follow it. At the same time, the man has no right to demand anyone follow it, outside of asking for courtesy for his conditions.

Don't worry about it too much. The man can make some nasty calls and make waves, but your grandpa didn't break any laws. He simply failed to see the sticker (which he wasn't required to see in the first place).

I can see it can be frustrating to not have full mobility and be blocked from leaving the place, but the man was out of line. He also doesn't have any rights in demanding anyone follow his instructions. What he should have done is park in handicapped spot. The attendant would have been happy to guide him to a special spot, should he took responsibility in parking his van at the designated spot.

Does anyone know of an organization that would help pay for a wheelchair ramp for a van?
258

I have a 9 year old son with cerebral palsy and he's getting too big for my car. I'm in the process of buying a used van, but I'm going to need a ramp put in and I don't have the money to do it. A few people said the Lions Club, or Rotary Club. But, I've never had to ask for money from an organization. I'm just not sure where to start.

Another good one is the shriners, they sponser my daughter,5yo w/cerebral palsy. We haven't gotten a van yet,and I'm not sure if they will help.If you buy a new van, both Chevy and Ford have programs that will pay up to 500 and up to 1000$ of the retrofit.I looked for my favorite's links to some site's,but could not find them.Try searching handicap accessible grant.

Best car to be converted for two wheelchairs?
266

My twin sister and I (diagnosed with FOP) are in manual wheelchairs, and we are researching for the best car to be converted into a wheelchair access car, here in Australia.

The specs:
Two manual wheelchairs
Ramp access from the rear, no hoist/lifts
SAFETY is the first important notion - the vehicle has to be problem free.

Our mum currently owns a Chrysler Grand Voyager, 2006-2008 model, before we became wheelchair bound. The car conversion company she's talked to said that it's too short for two wheelchairs, and suggested a Kia Carnival, but others said that it has engine problems so it's been crossed off the list. We looked at the 2009 Chrysler Grand Voyager but don't know if it's too short for two wheelchairs.

Any recommendations? What cars have other people used or seen that was converted for two wheelchairs? We would like the car to look more 'flashy', like the Chrysler, instead of a 'bus' or delivery van like a Renault Kangaroo.

any mini van can b converted to hold 2 wheelchairs... as fo rthe ppl saying that it wont work they r going of the electric wheelchair specifications....any mini van type vehicle will work jsut will have to modify it to have space for the ramp and or install a winch to aid getting the chairs loaded

  • Equip Your Car With Wheelchair Lift

Now there goes a question: if there are at least 3 helpers who can carry and help a patient get out of the car, why buy wheelchair lift for car? Primarily, the three helpers may not be always present to do the job. Given enough monetary budget it pays to invest on car wheelchair lift to complete the accessories necessary to mobilize patients in wheelchair. You will notice, living with a patient with such disability has the most car trip to hospitals and clinics for periodic check-up. The practical side of investing on a unit is the idea of re-selling it after it is no longer needed in the future. Wheelchair lift for cars is an item you can auction, which can get prospective buyer in times of...
