Electric Mobility Wheelchair

The traffic code governing this is 551.201. We have a debate between another officer and myself whether you can write a DWI on someone in a electric wheelchair. I say he is considered a pedestrian (I am a rookie officer but freshly studied traffic code) he is a vetern officer who is very experienced. We are looking for the textbook answer, not what we can do in the courtroom. We welcome your opinions.

No, not for purposes of DWI. Keep in mind that DWI is covered by the Texas Penal Code. The Texas Transportation Code is not relevant for DWI.

Driving while intoxicated is covered under Section 49.04 of the Texas Penal Code, which refers to a "motor vehicle". Section 49.01 refers us to Section 32.34(a) for the definition of a "motor vehicle".

Section 32.34(a) of the Texas Penal Code defines "motor vehicle" as "a device in, on, or by which a person or property is or may be transported or drawn on a highway, except a device used exclusively on stationary rails or tracks."

Obviously, an electric wheelchair cannot transport a person on a highway, so it's not a motor vehicle according to the Texas Penal Code.

disability to a certain extent,

Years ago there was a news story about a man that developed wheelchair mobility assist device whereby instead of gripping the wheel rims, there are two levers to move forward, backward, or spin.

Each has a handle that when you grip it, it applies a pressure brake pad, similar to a bicycle brake, to the wheel on each side. Except when you grip it and move the lever, it moves the wheel. Or when going down a ramp, can be used to slow down.

It's a simple enough device that I could recreate, but I would rather find the original creator. I would rather not go to using an electric wheelchair, as it's not very healthy. You don't get much exercise with them.

Check with the local medical supply stores in your area. They should be able to tell you where to get what you are looking for and if something like that is available.

We will be staying on holiday in Conil de la Frontera in Cadiz province

Try phoning the Aldiana hotel at La Barrosa, Chiclana. They might be able to help. They are friendly but answer the phone in German!

There is nothing at Conil but you could try phoning the Hotel Flamenco and ask for advice.
