What is the best mobility car for an electric wheelchair?

Also would prefer if the car had at least 5 seats but i don't want a minibus. Also i am a new driver and short in height, so i don't want something that is too larger.

Is it rude for someone in a electric wheelchair to run my feet over?

I feel sorry for handicapped people who are in a wheelchair but sometimes when I am walking by them or if I am on the bus, they would run my feet over with the electric wheelchair and not watch where they are going!!!!! So is that still rude of them?! I don’t care if they are in a wheelchair and handicapped or not, that doesn’t give them the right to not watch what they are doing?! Its called having manners.

Can a drunk handicapped person, who is operating an electric wheelchair, be charged with a DUI?

I know you can get a dui on a bike or skate board, I am just curious. I just happened to see a drunk person opperating an electric wheelchair today. He was all over the place, in the bushes, in the street. I asked him if he wanted help but he said no in a drunken slur. He said his apartment complex was two miles from the bar and he would make it home in his wheelchair. Then he ran in to the curb. I got him up and going again, but he was really weaving.

The traffic code governing this is 551.201. We have a debate between another officer and myself whether you can write a DWI on someone in a electric wheelchair. I say he is considered a pedestrian (I am a rookie officer but freshly studied traffic code) he is a vetern officer who is very experienced. We are looking for the textbook answer, not what we can do in the courtroom. We welcome your opinions.


No, not for purposes of DWI. Keep in mind that DWI is covered by the Texas Penal Code. The Texas Transportation Code is not relevant for DWI.

Driving while intoxicated is covered under Section 49.04 of the Texas Penal Code, which refers to a "motor vehicle". Section 49.01 refers us to Section 32.34(a) for the definition of a "motor vehicle".

Section 32.34(a) of the Texas Penal Code defines "motor vehicle" as "a device in, on, or by which a person or property is or may be transported or drawn on a highway, except a device used exclusively on stationary rails or tracks."

Obviously, an electric wheelchair cannot transport a person on a highway, so it's not a motor vehicle according to the Texas Penal Code.
