What to do with a tenant you've had for years that now must use a wheelchair and property is not ADA safe?

Tenant moved in several yrs ago and was on disability since then kidneys are failing and must rely on a wheelchair to get around -no existing lease in effect - person needs to find a place that is ADA wheelchair accessible - How do I evict ? I have gave him notice to start looking for a new place the person is very indignant about it and threatening lawsuit. Also, person has become very overweight and is using that to the hilt.


depending on your state, you might have to put in a ramp for them.. if you kick him out because of a disabilty, you could and probably will be sued..

If you encounter discrimination, inform the landlord of your rights in a helpful way - don't be adversarial unless necessary. The rights and needs of disabled people are new to some. Many landlords don't know a companion or guide dog isn't considered a pet, or that you're entitled to make reasonable changes to make your apartment more livable. If you don't tell them, they may never know.

ADA wheelchair regulations?

I want to build some ada stuff and and i was wondering how steep ramps can be and the width and bathroom stall sizes and everything like that. if any one had a link that would be helpful thank you

Does anyone know of any ADA compliant, wheelchair accessible, subsidized apartments in the U.S.?

I am looking for a wheelchair accessible, 1 or 2 bedroom apt. in the cooler parts of the U.S. Must be really compliant, ie: all appliences in the kitchen must be lowered to wheelchair height, bathroom must be big enough to accommodate a wheelchair and a roll-in shower, bedrooms must be large enough to allow wheelchair on both sides of full sized bed. Must allow pets. Would like to have access to outdoor patio or someplace to sit outside.

Why are New York subway stations not required to be wheelchair accessable?

I'm in NY with my friend who uses a wheelchair to get around, and we've found that the majority of subway stations are not accessable. How is this not considered a violation of the ADA?


I'm not a native New Yorker -- but could it be that the Subway system isn't the only form of public transportation in New York? If it was the only form of transportation, it would have to be accessible to all. However, since there are many forms available, with some meeting the needs of disabled patrons, the Subway probably isn't required by law to meet those needs.

Is there a difference between Physician Handicapped Parking and Handicapped Parking spaces? Is it in the ADA?

I was told that because there was 3 physicians that were in wheelchairs that worked in the bldg that this handicapped parking place was designated for them "as the sign stated". It was the last parking place - close to the building. BUT the
only reason why I even question it is because I wanted to know if the ADA distingushes between disabilities.


Typically, there are physician only parking spots at medical facilities. The physician handicapped parking are a further limitation for who uses that spot.

    After working out at Healthtrax Fitness Center , my mom treated Ric, Amanda and I to lunch at Harry’s Bar & Grille. Thankfully it was a warm fall day; we chose to sit at an accessible table located on the outdoor patio because accessing the tables inside the dining room is extremely difficult because they are set too close together without enough room for my chair. Overall Harry’s Bar & Grille is not very wheelchair accessible and there is NO accessible seating in the lounge.

    When pulling into the parking lot I noticed there are 2 handicap parking spaces with the wheelchair accessible symbol only painted on the pavement; I didn’t see a wheelchair accessible symbol in front of these parking spaces which is required by the ADA. Accessible parking signs posted on poles or a building in front of the accessible parking space makes it easier for people to see where the accessible parking spaces are located.
